1. Introduction

 

Season Builder Foundation (“Season Builder,” “we,” “us”) is a nonprofit organization that provides personal growth and team culture development programs through the Season Builder App (the “App”).

 

The App delivers two distinct programs:

 

• Culture Builder – a team-based culture development program implemented by coaches

• Season Builder – an individual personal growth program entered through voluntary enrollment and consent

 

This document explains how the App is used, how information is handled, and the terms under which users engage with coaching content, AI-powered tools (Coach Edge), and program resources.

 

By accessing or using the App, you acknowledge that you have read, understand, and agree to this Privacy Policy and App Usage Disclaimer & Waiver.

2. Programs Delivered Through the App

 

The Season Builder App is a delivery platform for multiple programs offered by Season Builder Foundation. Each program has distinct use cases, access methods, and participation expectations, all governed by the shared terms in this document.

 

 

Programs Available

 

• Culture Builder – purchased and activated by a coach or organization

• Season Builder – purchased/granted and activated by an individual participant

 

 

 

3. Age Eligibility

 

The App is intended for users 13 years of age or older.

 

Users between the ages of 13 and 17 affirm that they have permission from a parent or legal guardian to use the App. The App is not intended for children under the age of 13, and Season Builder does not knowingly collect information from children under 13.

4. General Coaching & AI Disclaimer

 

All coaching-related content, communication, and interactions—whether delivered by a Season Builder coach or through the App—are intended to support personal growth, reflection, and perspective, not evaluation, diagnosis, or professional services.

 

The App does not allow private direct messaging between athletes and coaches or between minors and adult users. All AI interactions occur solely between the user and the Coach Edge system.

 

Coach Edge (Optional AI)

The App includes an optional AI-powered feature (“Coach Edge”) that generates responses using artificial intelligence provided through the OpenAI API. Use of this feature is entirely at the user’s discretion.

 

You understand and agree that:

 

• AI-generated responses are not guaranteed to be accurate, complete, or correct

• Responses are offered as ideas and perspectives, not instructions

• Coach Edge is a supportive tool, not a system that monitors or assesses users

• The App is not designed to review, evaluate, or provide intervention based on AI conversations

• Use of Coach Edge does not create a monitoring, reporting, or duty-to-intervene obligation for Season Builder

 

AI responses should never be relied upon for medical, mental health, legal, academic, or emergency decisions.

5. Not Medical or Mental Health Care

 

Season Builder does not provide:

 

• Mental health treatment or therapy

• Medical care or medical advice

• Counseling, psychotherapy, or psychiatric services

• Emergency or crisis intervention

 

If you experience psychological distress that interferes with your ability to function, you are encouraged to seek help from a licensed mental health professional.

In emergencies, contact local emergency services or the 988 Suicide & Crisis Lifeline.

6. User Responsibility & Parent or Guardian Rights

 

By using the App or engaging in any coaching-related interaction (“Interactions”), you acknowledge and agree that:

 

• You are fully responsible for your own well-being

• You retain full responsibility for your choices, decisions, and actions

• Coaching and AI tools are supportive resources, not decision-makers

 

Parent and Guardian Requests

Parents or legal guardians of users ages 13–17 may:

 

• Request general information about the App’s purpose and data practices

• Request deletion of a minor’s account and associated data

• Request confirmation that chat message content is not stored

• Contact Season Builder with questions or concerns regarding use of the App

 

Season Builder does not provide parents or guardians access to AI chat conversations or interactions, as those chats are not shared nor stored by Season Builder.

7. Culture Builder Program

 

7.1 Purpose

Culture Builder is a team culture development program designed to help coaches define, communicate, and reinforce a shared vision, values, principles, and standards within a team environment. Athletes receive access to the App because their coach or organization has implemented Culture Builder.

 

7.2 Voluntary Participation

Use of the App by athletes within Culture Builder is encouraged but not required. Participation is:

 

• Optional

• Not required for team participation

• Not tied to playing time, evaluation, discipline, or eligibility

 

Coaches should periodically remind athletes that app use is voluntary and may not be used for punitive or evaluative purposes.

 

7.3 Not a School Service

When used for Culture Builder:

 

• The App is not operated on behalf of any school or district

• The App does not collect or maintain educational records

• The App is not a required instructional or academic service

 

Coaches may recommend the App as a culture-support tool, but the App operates independently of schools and academic systems.

 

7.4 Coach Visibility of Usage Data

For Culture Builder teams, coaches may have access to limited, non-sensitive usage indicators, such as whether a user has engaged with content. Coaches do not have access to:

 

• Coach Edge chat messages

• AI conversations

• Personal reflections, disclosures, or message content

 

These usage indicators are presented in a way that minimizes comparison pressure and are intended to support reinforcement of team culture, not evaluation or discipline.

 

 

8. Season Builder Program (Individual Enrollment)

 

 

8.1 Purpose

 

Season Builder is an individual personal growth program entered through voluntary enrollment and informed consent.

 

Participants choose to engage in the program for personal development related to mindset, character, purpose, and growth.

 

 

8.2 Voluntary Enrollment & Consent

 

Participation in Season Builder:

 

• Is initiated by the individual user

• Requires informed consent

• Is not connected to team participation or coach requirements

 

 

8.3 Confidentiality

 

Season Builder will protect participant information to the extent reasonably possible. Confidentiality may be limited only when:

 

• Required by law or court order

• Necessary to address credible threats of harm to self or others

• Required to report suspected abuse or neglect

9. Data Collection & Storage

 

What We Do Not Intentionally Store

 

• Chat messages or conversation content

• Personal reflections entered into Coach Edge

 

What We Do Store

 

• Account information (e.g., name, email, current school/organization, current sport)

• Conversation identifiers used to facilitate context with AI interactions

• Limited usage indicators (e.g., login dates, number of total logins, content accessed)

• Device and language preferences

 

Messages entered into Coach Edge are transmitted securely to OpenAI to generate responses. Season Builder does not intentionally store message content in its databases, and no system is designed to extract chat content from logs or analytics.

 

10. Technology Risks

 

You acknowledge that electronic communication and cloud-based technology are not always secure. By using the App, you accept the inherent risks associated with electronic communication.

 

 

11. Release, Waiver, and Limitation of Liability

 

By using the App, you release and waive all claims against Season Builder Foundation, its coaches, officers, employees, agents, and affiliates arising from:

 

• Use of the App

• Coaching content or AI-generated responses

• Decisions or actions taken based on App content

 

No guarantees are made regarding outcomes or results.

 

This waiver binds you and your heirs, executors, successors, and assigns.

 

 

12. Governing Law

 

All services provided by Season Builder Foundation are deemed provided in the State of Alabama and governed by Alabama law.

This policy may be updated periodically. Continued use of the App indicates acceptance of any updates.
